1. About Swift Swap

 

Swift Swap Car Hire (“Swift Swap”, “we”, “us”, “our”) provides accident replacement vehicles to eligible not-at-fault drivers in South Australia while their vehicle is being assessed or repaired following a motor vehicle accident.

 

 

2. Eligibility

 

Replacement vehicles are available only to drivers who are not at fault in a motor vehicle accident.

 

Provision of a replacement vehicle is subject to:

• Confirmation of accident circumstances

• Insurer acceptance of liability

• Vehicle availability

 

Swift Swap reserves the right to decline or withdraw a replacement vehicle if eligibility requirements are not met.

 

 

3. Insurer Payment & Customer Responsibility

 

Swift Swap will make reasonable efforts to recover hire costs from the at-fault party or their insurer.

 

If an insurer declines, limits, or delays payment, Swift Swap will assess the circumstances on a case-by-case basis. Where the customer is genuinely not at fault and has reasonably cooperated with the claims process, Swift Swap may, at its discretion, waive or reduce some or all outstanding hire charges.

 

Nothing in these terms obliges Swift Swap to waive charges in circumstances involving misrepresentation, non-cooperation, or unlawful use of the vehicle.

 

 

4. Authority to Act

 

By using our service, customers authorise Swift Swap to:

• Liaise with insurers, repairers, assessors, and other relevant parties

• Seek recovery of reasonable hire costs from the at-fault party or their insurer on the customer’s behalf

 

This authority does not remove the customer’s responsibility should insurer payment not be obtained.

 

 

5. Duration of Hire

 

Replacement vehicles are provided only for the reasonable repair or assessment period, as determined by the repairer and/or insurer.

 

Hire must cease once:

• Repairs are completed

• The vehicle is deemed driveable

• Or alternative arrangements are made

 

 

6. Use of Vehicle

 

Customers must:

• Hold a valid Australian driver licence

• Use the vehicle lawfully and responsibly

• Not allow unauthorised drivers to operate the vehicle

 

The vehicle must not be used:

• While the driver is under the influence of alcohol, illicit drugs, or any substance that impairs the ability to drive safely

• In any manner that is unlawful, unsafe, or contrary to road rules

• For racing, commercial use, or off-road driving unless expressly approved by Swift Swap

 

Any breach of this section may result in insurance cover being voided and may affect Swift Swap’s ability to recover hire costs from an insurer.

 

 

7. Customer Responsibilities

 

The customer is responsible for:

• Fuel

• Tolls

• Parking fees

• Traffic or parking infringements

• Cleaning beyond reasonable wear and tear

 

These costs are not covered by Swift Swap or insurers.

 

 

8. Insurance & Excess

 

All vehicles are comprehensively insured.

 

An excess may apply in the event of damage, loss, or theft, depending on the circumstances and the terms of the applicable insurance policy. Further details may be provided at the time of vehicle handover.

 

 

9. Limitation of Liability

 

To the extent permitted by law, Swift Swap is not liable for any indirect, incidental, or consequential loss arising from the use of a replacement vehicle.

 

Nothing in these terms excludes or limits rights available under Australian Consumer Law.

 

 

10. Changes to Terms

 

Swift Swap may update these Terms & Conditions from time to time. The most current version will always be available on our website.

 

 

11. Governing Law

 

These Terms & Conditions are governed by the laws of South Australia, and any disputes will be subject to the jurisdiction of South Australian courts.

 

 

Replacement vehicles are subject to eligibility, availability, and insurer approval.
